Family and Medical Leave (FMLA)

Who is Eligible

Regular employees working half time or more and have worked for FCPS the past 12 months

Type of Leave Covered

  • Birth, adoption, or foster care placement of a son or daughter
  • Care for employee’s spouse, son, daughter or parent with a serious health condition
  • Serious health condition of the employee

Designation of FMLA Leave

  • Employee may take up to 12 weeks of leave during a 12-month period for FMLA-qualifying absences
  • When both spouses are employed with FCPS and are eligible for leave, both employees may take a total of 12 weeks for certain family medical reasons
  • The 12-month period for FCPS begins each July 1
  • FMLA leave may consist of paid or unpaid leave
  • Serious health condition is defined as a condition requiring medical care and if left untreated, would result in a period of incapacity of more than three days

Benefits During FMLA Leave

  • Health/dental insurance coverage will continue under same conditions that applied before FMLA leave started
  • Employee may return to same position or to a position with equivalent pay, benefits and other terms of employment
