The Division of Legal Services provides legal advice and counsel to the Board of Education, Superintendent, and school system staff to ensure compliance with relevant Maryland and federal laws. The Division’s responsibilities include: oversight over administrative and judicial litigation involving the Board of Education and the school system, administration of Public Information Act and subpoena responses, performing legal review of system agreements, and policy and regulation development and updates. The Chief Legal Counsel is the school system’s chief legal advisor, serves on the Superintendent’s Cabinet, is the Superintendent’s designee to the Board of Education’s Policy Committee and the secretary to the Board of Education’s Ethics Panel, acts as liaison to outside attorneys, and represents the Superintendent in legal proceedings before the Board of Education.

The Board of Education authorized the electronic receipt of service of subpoenas requesting certified business records. While the traditional methods for service remain in place, parties may now serve a record subpoena via email to [email protected]. Legal Services encourages anyone who seeks to serve a subpoena for an FCPS employee’s testimony at a deposition, hearing, or trial to contact the Legal Services Division at (240) 586-8606 or [email protected] for assistance.
